Terms & conditions
These terms govern freight services provided by The Universe Phoenix Services Pty Ltd ("TUPS", "we", "us"). By booking a shipment you agree to these terms.

1. About these terms
These terms and conditions apply to all freight, forwarding and related logistics services we provide between Australia and Vietnam, and domestically within each country. They operate together with, and incorporate by reference, our logistics policy and published rates. Where there is any inconsistency, these terms prevail.
2. Quotes, bookings & charges
- Quotes are based on the information you provide and our published rate schedule, and are estimates until a shipment is received, weighed and measured.
- Charges are calculated on chargeable weight (the greater of actual and volumetric weight) plus any applicable surcharges, as set out in our logistics policy.
- GST of 10% applies to domestic Australian services; international freight is GST-free.
- All charges are payable in Australian dollars unless otherwise agreed in writing.
3. Your obligations
- Pack goods to our packing standard and declare contents, value and any dangerous or restricted goods accurately.
- Ensure the goods are lawful to export from the origin and import into the destination.
- Provide complete and correct sender and recipient details.
- Obtain any permits or licences required for your goods.
4. Prohibited & restricted goods
You must not tender goods that are illegal, hazardous, counterfeit, or prohibited by any carrier, customs authority or applicable law. We may refuse, hold, return or dispose of such goods, and you indemnify us against any resulting loss, fine or penalty.
5. Customs & duties
We act as the sender's agent for documentation and customs clearance. You remain responsible for the accuracy of declarations and for any duties, taxes, inspection costs or penalties imposed by customs authorities. We are not liable for delays caused by customs or border processes outside our control.
6. Transit times
Transit times quoted are indicative only and are not guaranteed. They exclude time lost to customs, weather, carrier schedules, force majeure or other events outside our reasonable control.
7. Liability & compensation
- For insured shipments, compensation is available up to 100% of the declared value.
- For uninsured shipments, our liability is capped at $30 per kg or $600 per shipment, whichever is lower.
- Claims must be lodged within the time limits set out in our logistics policy (24 hours for senders; 36 hours for business sellers).
- To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of profit or business.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.
8. Cancellations & refunds
Cancellation of an unprocessed order is refundable less a 5% administration fee and any third-party pickup minimums already incurred. Approved refunds are processed within 5–10 business days. Orders already in transit or cleared through customs cannot be cancelled for a freight refund.
9. Privacy
We handle personal information in accordance with our privacy policy and the Australian Privacy Principles.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
11. Changes & contact
